A Lasting Power of Attorney (LPA) is one of the simplest ways to protect yourself and your family if you ever become unable to make decisions.
It lets you choose trusted people (your “attorneys”) to help you with decisions about your money and/or your health and care.

When should you make an LPA?
Most people make an LPA to avoid a crisis later. You must be 18 or over and have the mental capacity to make your own decisions at the time you create the LPA.
If capacity has already been lost, an LPA can’t be made and you may need a Court of Protection deputyship instead (we can advise on that route).
How the process works
- Choose your attorneys (and replacement attorneys, if appropriate)
- Complete the LPA forms and arrange the required signatures
- Notify any “people to notify” (if you’ve chosen to list them) before registration
- Register the LPA with the OPG so it can be used
- Store safely and create certified copies for banks, care providers, etc.

What are the two types of LPA?
1. Health and Welfare LPA
This covers decisions about things like:
- daily routine and care
- medical treatment
- moving into a care home
- life-sustaining treatment (you must make a specific choice on the form)
This type of LPA can only be used when you’re unable to make your own decisions.
2. Property and Financial Affairs LPA
This covers decisions about things like:
- managing bank accounts and paying bills
- collecting benefits or pension
- selling your home
This type can be used as soon as it’s registered, with your permission.
Do I need one LPA or two?
You can make one type or both. Many people choose both so their finances and health/care decisions are covered.
When does an LPA start working?
A Property and Financial Affairs LPA can be used once it’s registered (with your permission). A Health and Welfare LPA can only be used when you cannot make those decisions yourself.
How long does registration take?
Typically 8 to 10 weeks if the application is simple.
What happens if we make a mistake?
Errors can cause delays. In some cases, OPG may allow a correction and re-application within 3 months at a reduced fee.
What if it’s too late to make an LPA?
If someone no longer has capacity, you may need a Court of Protection deputyship application instead.
